§ 97.17 ENFORCEMENT.
   (A)   The local government agency or the person who owns or operates a public place shall, at a minimum, do the following in order to prevent smoking in public places: post signs at the entrances to places where smoking is prohibited which state that smoking is prohibited or that the indoor environment is free of tobacco smoke.
   (B)   (1)   Violations.
         (a)   Failure to comply with the terms of this chapter shall be a violation and such violation shall constitute a nuisance to the public.
         (b)   Each instance of tobacco product or vapor product use in violation of this chapter shall constitute a separate violation.
         (c)   Causing, permitting, aiding, abetting, or concealing a violation of any provision of this chapter regarding tobacco product or vapor product use shall also constitute a violation of this chapter.
      (2)   Enforcement. Enforcement of this chapter shall be the responsibility of the city’s Police Department. In addition, any peace officer or code enforcement official may enforce this chapter.
