§ 73.23 RIGHT-OF-WAY TO PARALLEL PARKING SPACE.
   (A)   (1)   The driver of any vehicle intending to occupy a parallel parking space where a backing movement is necessary and which is being vacated by another vehicle shall stop his or her vehicle to the rear of the parking space until the vacating vehicle has cleared and entered normal traffic.
      (2)   He or she then shall be deemed to have the right-of-way to such parking space over any other vehicle attempting to park therein.
   (B)   The first of two or more vehicles to reach the rear boundary of an unoccupied parallel parking space where a backing movement is necessary to occupy shall be deemed to have the right-of-way to such parking space.
