§ 71.22 DRIVING UNDER INFLUENCE OF DRUGS OR ALCOHOL.
   (A)   Drugs.
      (1)   No person shall drive, operate or be in actual physical control of any motor vehicle upon any highway who is under the influence of any substance included in the Uniform Controlled Dangerous Substance Act (63 O.S. §§ 2-101 et seq.). The fact that any person charged with a violation of this provision is or has been lawfully entitled to use such controlled substance shall not constitute a defense.
      (2)   Any person who violates this section shall be guilty of an offense and, upon conviction thereof, shall be fined as provided in § 10.99 of this code of ordinances.
   (B)   Alcohol.
      (1)   It is unlawful for any person who is under the influence of intoxicating liquor to drive, operate or be in actual physical control of any motor vehicle in the city.
      (2)   Any person who operates a motor vehicle while his or her ability to operate such motor vehicle is impaired by the consumption of alcohol shall be subject to punishment as provided in § 10.99 of this code of ordinances.
