(A) Container size; placement. The City Council, by motion or resolution, shall prescribe the size and kinds of containers in which garbage and other refuse shall be placed, and the location where such containers are to be placed for pick up.
(B) Containers provided by owner or occupant. Every owner, occupant, tenant or lessee using and occupying a residence, building, house or structure within the corporate limits of the city shall provide and maintain garbage containers and receptacles for refuse and rubbish. Such containers and receptacles shall be of the kind and character hereinafter specified. Each owner, occupant or lessee shall place the containers and receptacles and maintain the same at the place or places specified in this chapter.
(C) Capacity; number; material. Each owner, occupant or lessee shall provide one garbage can constructed of some substantial metallic or plastic material, watertight, having a tight metal or plastic lid or cover and with substantial handles on the sides. Plastic bags shall be required in which garbage shall be placed within garbage cans. Each garbage can shall be of the following capacity:
(1) For each family dwelling unit, one or more container (as necessity requires), each container not more than 95 gallon capacity; and
(2) For all rooming houses, stores, hotels, restaurants, business retail and office buildings, one or more container (as necessity requires), each container not eight cubic yard capacity.
(D) Container for dry refuse. Every owner, occupant or lessee shall, in addition to providing the garbage container set forth in division (C) of this section, provide and maintain a suitable metal or plastic container for dry garbage and refuse, excepting cinders, ashes, rock, iron and other dry heavy waste material, which is to be piled so as to be accessible to the collector.
(E) Lids kept on containers. The lids or covers of such garbage containers shall at all times be kept on and fastened so that flies and other insects may not have access to the refuse contained therein, and shall only be removed while emptying additional garbage or refuse therein, or while the contractor or person authorized is removing such garbage or unloading the same for disposal.
(F) Placement on lot. The owner, occupant or lessee shall at all times keep and maintain such containers and receptacles at the rear of the lot or premises abutting on the alley or in such place that the same may be readily accessible to the collector who removes such garbage or refuse.
(G) Placement on street. For those residences serviced from the street and receiving curbside service, unless otherwise directed due to special circumstances, carts are to be placed in front of the curb with handles facing away from the street. Carts must be placed in an obstacle free open area with no obstructions within five feet on either side of the container. Carts are to be placed at the curb not prior to 5:00 p.m. the night prior to the day of collection and no later than 7:00 a.m. on the day of collection. Residents must remove containers from the curb no later than 8:00 a.m. the morning following collection days. Carts observed to be at the curb at times not allowed may be removed from the curbside by city officials, or any agent thereof, and relocated near the front edge of the residence or near the garage area.
