§ 53.03 GARBAGE DEPARTMENT OR CONTRACT AUTHORIZED.
   (A)   City authority; contract. The City Manager and City Council are hereby authorized to create a Garbage Department of the city and to hire sufficient help to operate the Department and to purchase any equipment necessary to properly conduct the Department; or they may enter into a contract with some suitable person, or person, firm or corporation, for the removal and disposal of the garbage and refuse, and such contract may continue in force and effect for a period of not less than one nor more than two years.
   (B)   Bond for contractor. Any such contractor or garbage collector acting under contract shall furnish a good and sufficient surety bond conditioned for the faithful performance of such contract and all the requirements of this chapter.
   (C)   Equipment provided by contractor. Any person, firm or corporation who receives such contract from the city shall provide the necessary equipment to properly remove such garbage.
