§ 52.09 LICENSE AND FEE FOR DISCHARGE OF SEPTIC TANK MATERIALS.
   (A)   License holder. The holder of a septic discharge license shall be an individual, and not a business. The license will be valid for one year.
   (B)   License fee. The yearly septic discharge license fee is $250, which shall be paid to the City Clerk. The fee is due when the license is granted and upon the annual renewal of the license. The license shall not be valid unless and until the annual fee has been paid.
   (C)   Security deposit. Every applicant for a septic discharge license, or for renewal of said license, shall be required to maintain a security deposit with the city as a precondition to issuance, reissuance or renewal of the septic discharge license. The amount of the security deposit shall be $250. The security deposit shall be paid to the City Clerk, who shall keep a record of the balance attributed to each licensed operator. Fees for each separate discharge shall be drawn from this deposit. When the deposit is exhausted and/or when the operator renews his or her license, the operator must restore the balance of the deposit to $250.
   (D)   Return of deposit. The holder of the septic sanitation service license shall be entitled to return of the deposit, or the remainder thereof not applied as provided in this section, without interest, upon request, after the holder has permitted his or her septic sanitation service license to expire and after payment of all outstanding fees, surcharges, and any interest or late charges thereon due for septic materials discharged by the holder while engaging in business under the license.
   (E)   Fee per discharge. The fee for each discharge of septic material at the wastewater treatment plant shall be $50 per release. A RELEASE is defined as one release of effluent from one tank, regardless of whether the tank is full or not.
