Notwithstanding any other provisions of this chapter, an owner, operator, manager, or other authorized person in control of an establishment, facility, or outdoor areas may declare that entire establishment facility or outdoor area as a non-smoking place regardless of its designation under this chapter. In such areas designated as non-smoking, signs must be posted according to the specifications listed in § 95.10, and smoking will not be allowed as if those areas were subject to the prohibitions of §§ 95.04 through 95.06.
