(A) Any person, business, school, church, charitable or non-profit organization, club or civic organization, or commercial or industrial location that maintains a dumpster on its property to dispose of garbage or refuse of any kind must meet the following requirements.
(1) A dumpster must be of a size appropriate to its location and for the amount of garbage or refuse regularly placed into the dumpster before it is emptied.
(2) A dumpster shall be located, within reason, to minimize conflicts with nearby buildings.
(3) No dumpster will be approved for use at any residential property containing four or fewer residences.
(4) No dumpster shall be located within ten feet of the right-of-way of any street, road or highway.
(5) No dumpster shall obstruct safe sight distances for traffic and pedestrians.
(6) No dumpster shall obstruct views of traffic signs or street signs.
(7) No dumpster shall be located on a sidewalk or any public way.
(8) No dumpster shall be located within 15 feet of a window or door of a building on an adjacent lot.
(9) The area surrounding a dumpster shall be maintained free of litter, the lids shall be kept closed when not in use and dumpsters shall not be overflowing with debris.
(10) Any dumpster located within 15 feet of an adjacent residentially zoned property (as seen from any point on the property line at a height of six feet), must be screened on any side facing such lot. Dumpsters may be screened with a weather-resistant solid wood fence, decorative masonry wall, evergreen plants or a structure designed to be architecturally compatible with the principal building on the lot where the dumpster is located. The screening shall not interfere with the collection of garbage or refuse from the dumpster.
(B) Any dumpster currently located in the city that meets the requirements of divisions (A)(1) through (A)(9) above may remain at its current location and is exempt from the screening requirements in division (A)(10) above unless the dumpster is voluntarily moved, removed or replaced with a larger dumpster, or if the property changes ownership.
