§ 94.19 HOBART LAKE.
   (A)   Camping and fires.
      (1)   Campsites. Camping at one or more campsites at Hobart Lake is limited to a period no longer than 14 days consecutively.
      (2)   Permanent camping facilities. The installation of permanent camping facilities is prohibited.
      (3)   Ground digging. The digging or leveling of any ground or construction of any structure is prohibited.
      (4)   Quiet hours. Quiet hours will be enforced from 10:00 p.m. until 6:00 a.m. Loud noises that may disturb the peace are prohibited during these hours.
      (5)   Juvenile campers. No person who is a juvenile shall camp in any area of Hobart Lake except when accompanying a parent or guardian or by obtaining prior consent in writing from the City Manager or his or her designee.
      (6)   Camping unit limits. Camping will be limited to no more than two camping units per campsite.
      (7)   Improper disposal of burning material. Improper disposal of lighted materials, matches, or other burning material is prohibited.
      (8)   Unattended fires. Fires shall not be left unattended and must be completely extinguished prior to departure.

   (B)   Wading. No person shall wade in Hobart Lake without waders.

   (C)   Fishing.
      (1)   Open for fishing all year; exception. Subject to the provisions of this subchapter, Hobart Lake shall be open to the public for fishing all year, except for periods when fishing is prohibited by the game and fish laws of the state.
      (2)   Federal, state and local laws. All federal, state, and local laws governing fishing apply on Hobart Lake lands and waters.
      (3)   Fishing areas. No person shall at any time engage in fishing on Hobart Lake in an area posted prohibiting fishing.
      (4)   Method of fishing generally.
         (a)   It is unlawful for any person to take, catch, or kill any fish from the waters of Hobart Lake by any means, except with hook and line attached to a pole or rod.
         (b)   It is unlawful for any person to take, catch, or remove from the waters of Hobart Lake any game fish with any sort of net trammel, net seine, gun, trap, wire, pot, spear, or gig.
         (c)   Fishing by trotlines, jug lines, throw lines, limb lines, and yo-yos are prohibited in all areas of Hobart Lake.
      (5)   Bait. Any type of live or artificial bait may be used without restriction.
      (6)   Sale of catch prohibited. No person shall sell or offer for sale any fish caught by him or her from Hobart Lake, but shall use the same exclusively for consumption by himself or herself and his or her immediate family or guests. Any person who shall sell or offer for sale, or have in his or her possession for the purpose of selling, any fish caught by him or her or any other person from the lake shall be guilty of a misdemeanor.
      (7)   Fishing may be prohibited during spawning season. The Mayor and City Council may, at their discretion, close the lake during that period of the year which is commonly known as the “spawning season.” In the event the lakes are so closed, any person regardless of whether or not he or she has a fishing permit for such period will not be permitted to fish during such period.

   (D)   Boating. Boats and canoes may be operated on Hobart Lake but swimming, skiing, tubing, and personal watercrafts are specifically prohibited on Hobart Lake.
   (E)   City not liable for accidents. Any person using a canoe or boat of any kind on Hobart Lake shall do so at his or her own risk. He or she shall assume all risks due to conditions of the lake and the city shall not be liable to him or her or to any other person who may be riding with him or her in such boat or canoe, for any accidents arising from any cause whatsoever.

   (F)   Vessels.
      (1)   Oklahoma Boating Safety Regulation Act. All vessels and operators of vessels on the waters of Hobart Lake shall comply with the rules and regulations set forth in the Oklahoma Boating Safety Regulation Act, 1993, being 63 O.S. §§ 4200 et seq.
      (2)   Personal flotation device/requirements.
         (a)   No person shall operate, or give permission to operate, any vessel on the waters of Hobart Lake unless such vessel is equipped with a Coast Guard approved, wearable, personal flotation device for each person on board and of a size suitable to the person who is or will be wearing it.
         (c)   In addition, every vessel must be equipped with at least one type IV throwable personal flotation device.
         (d)   All personal flotation devices must be in good and serviceable condition.
         (e)   All personal flotation devices must be placed so as to be readily accessible.
      (3)   Personal flotation device/required for children. No person shall operate, or give permission to operate, any vessel on the waters of Hobart Lake without requiring all persons on board who have not reached the age of 13 years to wear a Coast Guard approved personal flotation device of the proper size while underway.

   (G)   Control of animals.
      (1)   Physical restraint of animals. No person shall bring or allow dogs, cats, or other pets or animals into any area of Hobart Lake unless penned, caged, on a leash under six feet in length, or otherwise physically restrained.
      (2)   Swimming. Swimming on Hobart Lake is prohibited.
      (3)   Animal waste. Persons bringing or allowing pets in designated public areas shall be responsible for proper removal and disposal in sanitary facilities of any waste produced by these animals.
      (4)   Livestock. No person shall bring or allow horses, cattle, or other livestock in camping, picnicking, or other recreation areas except in those areas designated for this use.
      (5)   Livestock use of lands and water. Ranging, grazing, watering, or allowing livestock on Hobart Lake lands and waters is prohibited except where authorized in writing by the City Manager or his or her designee.
      (6)   Impoundment of animals. Unclaimed or unattended animals are subject to immediate impoundment and removal in accordance with city ordinances and an impoundment fee levied. This fee shall be paid before the impounded animal is returned to its owner(s).
      (7)   Field trial or game dogs. Training or working field trial or game dogs under the control of a handler in a designated area shall not require a leash while engaged in either a training or field trial activity.

   (H)   Alcoholic beverages/beer.
      (1)   Alcohol/alcoholic beverages. No person who has not reached the age of 21 years shall possess, display, or consume any alcohol or alcoholic beverage in any area of Hobart Lake.
      (2)   Public intoxication. No person shall appear in public in any area of Hobart Lake who is intoxicated or under the influence of alcohol or any substance included in the uniform controlled dangerous substance act.
      (3)   Alcohol/alcoholic beverages furnished to underage persons. No person shall give, sell, or otherwise furnish any alcohol or alcoholic beverage for human consumption to any person who has not reached the age of 21 years, in any area of Hobart Lake.
      (4)   Sale of alcohol/alcoholic beverages. No person shall sell, or permit any person to sell any alcohol or alcoholic beverage for human consumption in any area of Hobart Lake. The sale of alcoholic beverages is permitted within the confines of a business licensed by the state and the city and authorized to conduct such business by the city.
      (5)   Alcohol/alcoholic beverages; special events. No person shall give, sell, or otherwise furnish, or shall give permission to any person to give, sell, or otherwise furnish, any alcohol or alcoholic beverage for human consumption to any person at any regatta, tournament, public celebration, or other similar special event without proper license, if required, and without first obtaining a special events permit from the City Manager or his or her designee specifying dates, times, areas, and the type of beverage.

   (I)   Special events.
      (1)   Special events prohibited without permission. Special events including, but not limited to, water carnivals, boat regattas, music festivals, fishing tournaments, or other special recreation programs are prohibited unless written permission has been granted by the City Manager or his or her designee.
      (2)   Fees. The public shall not be charged any fee by the sponsor of such event unless the City Manager or his or her designee has approved in writing the proposed schedule of fees.
