§ 155.033 C CONSERVATION DISTRICT.
   (A)   Purpose. This district is established to retain open space within the city and also to notify public bodies and the public in general of land which is constrained for construction activities.
   (B)   Special requirements. No filling, grading, dredging, excavation or construction shall be allowed within the Conservation District without having first obtained a conditional use permit from the city.
   (C)   Permitted uses. The following are permitted uses:
      (1)   Agricultural activities;
      (2)   Park; and
      (3)   Forest, nature or other preserve.
   (D)   Conditional uses. The following uses may be permitted:
      (1)   Structural park improvements; and
      (2)   Any fill proposed to be deposited in the Conservation District must be shown to have some beneficial purpose and the amount thereof must not exceed that necessary to achieve the intended purpose, as demonstrated by a plan submitted by the owner showing the uses to which the filled land will be put and the final dimensions of the proposed fill or other materials. The fill shall be protected against erosion by rip-rap, vegetative coverage, bulkheading.
   (E)   Conditional use standards.
      (1)   In extra-ordinary cases, conditional uses may be granted upon application, but only when the proposed use is determined to be in the public interest. No conditional use shall be granted which the council determines will or has a tendency to:
         (a)   Increase the height or duration of flood water in any watercourse;
         (b)   Be consistent with the objectives of encouraging land uses compatible with the preservation of the natural land forms, vegetation, wildlife, marshes and wetlands within the city; and
         (c)   Develop land and water areas essential to continue the temporary or permanent holding of run-off of surface water.
      (2)   No conditional use shall be granted unless the applicant, in support of his or her application, shall submit engineering data, surveys, site plans and other information as the city may require in order to determine the effects of the development on the affected land and water areas.
