(A) Adult, sexually-oriented business establishments are permitted only within the General Business District or the Industrial District within the city. In addition, the following regulations apply.
(B) No adult establishment may be located within 1,000 feet of a park, school, church, library or a commercial day care center.
(C) No adult establishment may be located within 1,000 feet of another adult establishment.
(D) No adult establishment may be located within 1,000 feet of a residential zoning district.
(E) No adult establishment may be located within 250 feet of the right-of-way of an entry street to the city. For purposes of this division (E), an ENTRY STREET is defined as Interstate 35, Highway 48, Fire Monument Road, Old Highway 61 and County Road 134.
(F) The distances set forth in this section are to be measured from the nearest outside edge of the building housing the adult establishment, or the outside edge of the premises of the adult business if the adult business is located in a building containing other businesses, to the nearest boundary of the residential zoning district or the nearest boundary of the property containing a park, school, church, library, commercial day care center or other adult establishment.
(G) Interstate 35 does act as a natural barrier within the city; therefore, measurements which cross the interstate are exempted from the setbacks required in this chapter; provided that, screening and direct vision of the establishment is obstructed either with natural vegetation, landscaping or fencing from residential districts as determined by the Zoning Administrator and City Clerk-Administrator.
