(A) Nuisances. The following things are public nuisances, whenever they may be found within the city:
(1) Any elm tree infected with Dutch Elm disease;
(2) Any diseased elm tree or part thereof, including branches, stumps and firewood, or other material from which the bark has not been removed; and/or
(3) Any elm tree and part thereof infested by elm bark beetles.
(B) Abatement. It is unlawful for any person to permit any public nuisance, as defined in division (A) above, to remain on any premises owned or controlled by him or her within the city. Such nuisances may be abated in the manner prescribed by this subchapter.
