If, in a reasonable belief of any person or police officer, an animal presents an immediate danger to the safety of any person and/or the animal is threatening imminent harm and/or is in the process of attacking any person, the officer may destroy the animal in a proper manner. This is a last resort. Otherwise, the person or officer may apprehend the animal and deliver it to the pound for confinement as per the terms of § 90.03 of this chapter. If the animal is destroyed by the officer, a charge of $75 to dispose of the animal is payable by the owner of the animal. If the animal is found not to be a danger to the health and safety of any person or the city, it may be released to the owner or keeper in accordance with § 90.03 of this chapter.
