§ 117.44 SOLICITATION; ACCEPTANCE; DISCHARGE OF PASSENGERS.
   (A)   No driver shall solicit passengers for a taxicab except when sitting in the driver's compartment of the taxicab or while standing immediately adjacent to the curb side thereof. The driver of any taxicab shall remain in the driver's compartment or immediately adjacent to his vehicle at all times when the vehicle is on the street, except that, the driver of any taxicab may park and leave the taxicab on the streets for up to ten (10) consecutive minutes. A taxicab driver may otherwise park and leave his taxicab longer than ten (10) consecutive minutes, other than at a designated taxi stand, so long as he parks his taxicab in compliance with the traffic code of the city. Nothing herein contained shall be held to prohibit any driver from alighting to the street or sidewalk for the purpose of assisting passengers into or out of such vehicles.
   (B)   No driver shall solicit patronage in a loud or annoying tone of voice or by a sign or in any manner annoying any person or obstruct the movement of any person, or follow any person for the purpose of soliciting patronage.
   (C)   Drivers of taxicabs shall not receive or discharge passengers in the roadway but shall pull up to the right-hand side of the road and there receive or discharge passengers, except on one-way streets, where passengers may be discharged at either the right or left-hand sidewalk, or side of the roadway in the absence of a sidewalk.
   (D)   No driver shall cruise in search of passengers in such areas and at such times as would congest traffic or be dangerous to pedestrians and other vehicles.
   (E)   No driver shall permit any other person to occupy or ride in the taxicab, unless the person or persons first employing the taxicab shall consent to the acceptance of additional passenger or passengers.
   (F)   No driver shall permit more persons to be carried in a taxicab as passengers than the rate seating capacity of his taxicab as stated in the taxicab permit issued by the Commonwealth of Kentucky, Transportation Cabinet.
   (G)   No driver shall refuse or neglect to convey any orderly person or persons on request, unless:
      (1)   Previously engaged;
      (2)   Unable or forbidden by the provisions of this chapter to do so;
      (3)   The driver has reason to believe that the person is engaged in a violation of federal, state or local law, or
      (4)   The driver has just cause to fear injury to himself, his property, or his taxicab.
   (H)   It shall be a violation of this chapter for any driver of a taxicab to solicit business for any hotel, or to attempt to divert patronage from one hotel to another. No driver shall engage in selling intoxicating liquors, solicit, or advance any prostitution-related conduct or engage in the trafficking of controlled substances.
   (I)   No driver of any taxicab shall permit any person to ride on any part of the vehicle except the inside.
   (J)   No driver shall interfere in any way with another driver's lawful use of a taxicab stand.
