§ 97.01 FENCES REQUIRED.
   Every person, owning or controlling land on which there is situated a swimming pool which constitutes an obvious hazard or contains twenty-four (24) inches or more of water in depth at any point and has a surface area of more than ten (10) square feet, shall erect and maintain thereon an adequate enclosure surrounding the pool area, sufficient to make the body of water inaccessible to small children and animals. The enclosure, including gates therein, must be not less than five (5) feet above the underlying ground; all gates must be self-latching with latches placed at least four (4) feet above the underlying ground or otherwise made inaccessible from the outside. The enclosure may be a chain link fence, a solid wood fence or other protective fencing constructed in such a manner that a small child or animal cannot gain access through same, without gaining access through a gate.
