§ 39.18 LAYOFF.
   (A)   Upon the department head's recommendation and the Mayor's approval an employee may be laid off because of lack of work or funds.
   (B)   Layoffs shall be:
      (1)   Determined on the basis of the needs of the city.
      (2)   Determined with consideration to merit and job performance of the person considered for layoff.
      (3)   Determined with part-time, temporary, seasonal and probationary employees in a class being considered for a layoff prior to permanent employees.
   (C)   Two (2) weeks before the effective date of the layoff of a permanent employee the Mayor, through the department head, shall in writing:
      (1)   Notify the employee of the layoff;
      (2)   Explain to him or her the reasons for the layoff; and
      (3)   Certify whether his or her service has been satisfactory.
   (D)   An employee who has a satisfactory record of service, and is laid off, shall be eligible for re-employment in another position, provided that the employee meets the qualifications for the position and that the position is vacant.
