§ 39.08 DETERMINATION OF APPOINTMENTS.
   (A)   The qualifications of an applicant for a position shall be ascertained on the basis of the following, if applicable to the position:
      (1)   Information the applicant supplies on an application form prescribed and applied by the city;
      (2)   Written, performance, or physical examinations;
      (3)   Interviews;
      (4)   Information and evaluations supplied by the references whom the applicant names on the application;
      (5)   Any other appropriate information; and
      (6)   A background investigation.
   (B)   The names of all applicants who qualify for an appointment to a position of a particular class shall be submitted to the Mayor. No person may be appointed to a position unless verified information on an official application form indicated that the person has minimum qualifications set forth in the position descriptions.
   (C)   All non-elected city officers whose offices have been created as set forth in KRS 83A.080 shall be appointed by the Mayor solely in his discretion and without Council approval. All other city officers and employees, including police officers, shall be appointed by the Mayor, without Council approval (see KRS 83A.130 (9)). No regular full-time officer or employee of the city may be dismissed at will. Regular full-time officers and employees may only be dismissed for the reasons set forth in these personnel policies and only after the proper procedures have been followed.
   (D)   In the filling of a vacancy in a position above the entrance level, preference shall be given to promotion of present employees at the time the vacancy occurs.
