ADOPTING ORDINANCE
ORDINANCE NO. 1983-40
AN ORDINANCE TO RECODIFY THE ORDINANCES FOR THE CITY OF HILLSBORO, OHIO, CODIFYING, RENUMBERING, REVISING, AND REARRANGING EXISTING CODE OF ORDINANCES OF THE CITY, ADDING NEW MATTER, AND REPEALING VARIOUS ORDINANCES, AND TO DECLARE AN EMERGENCY.
   WHEREAS, the present permanent ordinances and code of ordinances of the City are inadequately arranged and classified and are insufficient in form and substance for the complete preservation of the public peace, health, safety, and welfare of the municipality and for the proper conduct of its affairs;
   Now therefore, BE IT ORDAINED by the Council of the City of Hillsboro, Ohio, that,
   Section 1.  The Code of Ordinances heretofore approved in manuscript for by this council be incorporated in this ordinance and that the same be and same is hereby adopted and enacted.
   Section 2.  Said Code of Ordinances contains all of the provisions of a general and permanent nature pertaining to the subjects therein enumerated and embraced.  All prior ordinances pertaining to the subjects treated in said code shall be deemed repealed from and after the effective date of said Code except insofar as the same are included in said Code.  All ordinances of a temporary or special nature, all other ordinances pertaining to subjects not enumerated and embraced in said Code of Ordinances and all ordinances passed subsequent to January 1, 1983, shall remain in full force and effect unless repealed by necessary implication.
   Section 3.  The Code of Ordinances of the City of Hillsboro, adopted December 6, 1965, as amended, modified and otherwise changed from time to time is hereby repealed upon the recodification of the Code of Ordinances, as adopted herein, becoming in force and effect except to the extent that such heretofore existing ordinances are restated and incorporated into the said recodification.
   Section 4.  Said Code of Ordinances shall be published in book form and certified as correct by the President of Council and Clerk of Council as provided by section 731.23 of the Revised Code of Ohio.  The Clerk of Council is hereby authorized and directed to publish a summary of all new matters contained in said Code of Ordinances as required by section 731.23.
   Section 5.  Each section and each part of each section of the ordinance and of the Codified Ordinances is hereby declared to be an independent section or part of a section and, notwithstanding any other evidence of legislative intent, it is hereby declared to be the controlling legislative intent that if any such section or part of a section, or any provision thereof or the application thereof to any person or circumstances, is held to be invalid, the remaining sections or parts of sections and the application of such provision to any other person or circumstances, other than those as to which it is held invalid shall not be affected thereby, and it is hereby declared to be the legislative intent that the other provisions of this Ordinance and of the Codified Ordinances would have been adopted independently of such section, sections or parts of a section so held to be invalid.
   Section 6.  This ordinance shall be in effect on and after January 1, 1984, after its passage by the Council and approved by the President.

   Section 7.  This Ordinance is hereby declared to be an emergency measure necessary to the safety and welfare of the inhabitants of the City of Hillsboro for the reason that it is necessary to have a modern and complete Code of Ordinances in force and effect on January 1, 1984.
