§ 96.22 DRIVEWAY CUTS.
   (A)   No person shall construct a driveway cut from property adjacent to a public right-of-way or street onto said right-of-way or street when said right-of-way or street is a state or federal highway or Harry Sauner Road, unless said driveway cut is more than 500 feet from the nearest driveway cut.
   (B)   This section shall have full force and effect within the city and within three miles of the corporation limits of the city.
   (C)   The Planning Commission shall have full authority to enforce or grant variances from this section and the Safety and Service Director may erect barriers upon public ways in the city to prevent use of unsafe or illegal driveway cuts.
   (D)   (1)   (a)   No driveway cut shall be permitted from any private parcel of property onto the right-of-way of Fenner Avenue unless the person desiring the driveway cut submits plans to and receives approval from the Safety and Service Director for a deceleration lane onto the driveway for right-turning vehicles from Fenner Avenue.
         (b)   The Director shall determine the safe distances and separations of the deceleration lanes, and the road specifications in consultation with the city’s engineer, which shall meet or exceed the specifications for other new streets in the city.
      (2)   Any person establishing a driveway cut as provided in division (D)(1) of this section may utilize the unused right-of-way of Fenner Avenue for construction of the deceleration lane, and the Safety and Service Director is hereby authorized to maintain the deceleration lane, and provide pavement markings when the lane is located upon city right-of-way.
