§ 32.044 ADDITIONAL DUTIES ASSIGNED TO CHIEF OF POLICE.
   (A)   Notwithstanding any other ordinance of the city, the Safety and Service Director is authorized to assign the additional function of IT responsibilities to the position of Police Chief and compensate the individual for the additional functions and responsibilities.
   (B)   Compensation for the additional duties may be made either through increasing the salary of the employee or providing a supplemental payment, which would be in addition to the salary for the position.
   (C)   (1)   The Chief of Police shall be provided a specific amount for the supplement for the IT function with provision that the supplement is to be paid to the person assigned by the Safety Service Director.
      (2)   Payment of the supplement would be comparable to other supplements adding the supplement to the salary.
   (D)   The Safety and Service Director may direct an increase the salary of the Police Chief by an amount designated for the additional duties.
   (E)   Whichever method is selected, the pay ordinance is hereby amended to indicate the supplemental compensation is for the additional duties, so long as the assignment remains, and that both that the additional compensation is based on additional duties and that the assignment or compensation for the assignment can be modified or removed in the future in order to protect the city against an allegation of reduction in pay in the event the city makes a change in the assignment of the IT duties.
   (F)   (1)   The Police Chief would remain in the classified civil service with the additional duties and supplemental pay.
      (2)   These duties will not change the civil service status of the position as the IT functions would not constitute a majority of the Chief’s duties and would not be fiduciary in nature.
