The United States Circuit Court of Appeals for the Sixth Circuit has held in a recent case that the Federal Railway Safety Act preempts local ordinances regarding railroad obstructions and railroad safety. See CSX Transportation, Inc. v. City of Plymouth, 86 F.3d 626 (6th Cir. 1996). Therefore, the provisions in this section, Railroad Trains Not to Block Streets, have been repealed. For current enforcement, please consult appropriate state law.
Obstructing streets by railroad companies, see R.C. § 5589.21
