§ 51.082 ADJUSTMENT TO UTILITY BILLS.
   (A)   Safety and Service Director authorized. The Safety and Service Director is authorized to make adjustments in water and sewer charges in cases where special conditions exist and water metered is not entirely discharged through the sanitary sewers. If it is unclear whether an adjustment should be made, all water discharged through the sanitary sewer shall be metered at the user’s expense.
   (B)   Criteria. No water or sewer bill shall be reduced by reason of any leakage or loss of water which has passed through the water meter unless it meets the following criteria:
      (1)   The nature and duration of any leaks in the water lines serving the customer;
      (2)   The ability of the customer to view and evaluate any leaks found in the system;
      (3)   The previous actions of the city and its employees in causing or contributing to the water loss of discovery of the leak;
      (4)   The liability of third persons for the water loss, who are not a water customer of the city; and
      (5)   The promptness and cooperation of the customer in reporting and correcting defects.
   (C)   Swimming pool fills. Customers may request a sewer charge only adjustment for one swimming pool fill per calendar year. No adjustment will be given under 300 cubic feet.
   (D)   Requests for adjustments. All requests for adjustments must be made to the utility billing office. In no case shall a water bill be reduced below the minimum monthly charge set forth in § 51.076. Water charge adjustments may be considered together with adjustments pursuant to § 50.040.
   (E)   Yard irrigation meter. Adjustment for yard irrigation will not be granted. Customers wanting an adjustment must buy a separate water meter from the city for yard irrigation, which said city water meter will be privately installed on their service line. The Utility Billing Department will set up a separate account for the yard irrigation meter. A “water only” bill will be issued for the yard irrigation and there is a monthly minimum for said yard irrigation meter.
