§ 51.060 OWNERS’ RESPONSIBILITY FOR WATER WASTE.
   (A)   The water line from the curb stop shut off valve to the premises to be served (“the service line”) shall be installed and maintained by the property owner. The city may shut off the water when leakage occurs in this pipe the service line and the property owner fails to repair it.
   (B)   In case of waste of water for want of repairs or negligence, the waste must be remedied forthwith, otherwise the water leading to the premises shall be turned off. If in any such case the water shall again be found on without knowledge or proper permit of the officers of the waterworks, the water to the premises shall be turned off or withdrawn, and not turned on until the total cost of turning off, or removing, and turning on shall be paid into the utility billing office, the amount so paid to be in no case less than $60. This shall be in addition to and not in lieu of any criminal sanctions provided by city or state law.
   (C)   In case of a leak in a service line between the building serviced and the curb stop shut off valve, the owner or occupant of the premises shall be notified either orally or in writing; and if the necessary repairs are not immediately commenced and prosecuted with reasonable dispatch, the Safety and Service Director or designee may order that the curb stop shut off valve attached to the main pipe may be turned off or withdrawn, or the necessary repairs made at the expense of the owner of the premises, which expense shall be paid as set forth in division (B) of this section before water shall again be turned on.
   (D)   In case of neglect or refusal of the owner to promptly repair any imperfection in the service line, or other privately-owned fixtures, the Safety and Service Director or designee may cause the repair to be done at the expense of the owner of the service, which expense shall be paid to the utility billing office before the water shall be turned on.
