§ 51.002 WATER SHED AREA.
   (A)   The city does hereby identify and establish areas from which surface water run-off supplies the major portion of the city’s current and future water supplies enclosed as follows:
      (1)   Northern Supply: Beginning at the center of the U.S. 62 and U.S. 50 intersection thence West on U.S. 50 to the intersection of U.S. 50 and S.R. 124; thence Northeast on S.R. 124 to the intersection of S.R. 124 and County Road 7, also known as Mad River Road; thence North on County Road 7 to the intersection of County Road 7 and County Road 8, also know as Panhandle Road; thence East on County Road 8 to the intersection of County Road 8 and S.R. 73; thence North on S.R. 73 to the intersection of S.R. 73 and County Road 92 also known as Ross Road; thence East on County Road 92 to the intersection of County Road 92 and County Road 22, also known as New Vienna Road; thence East on County Road 22 to the intersection of County Road 22 and County Road 10, also known as Careytown Road; thence South on County Road 10 to the intersection of County Road 10 and County Road 11, also known as High Top Road; thence East and South on County Road 11, as it changes into Fall Creek Road, to the intersection of County Road 11 and County road 49, also known as Kincaid Road; thence South on County Road 49 to the intersection of County Road 49 and S.R. 138; thence Southwest on S.R. 138 to the intersection of S.R. 138 and U.S. 62; thence South on U.S. 62 to the place of beginning; and
      (2)   Southern Supply: Beginning at the center of S. R. 124 and County Road 7, also known as Mad River Road; thence South on County Road 7 to the intersection of County Road 7 and County Road 5, also known as West New Market Road; thence East on County Road 5 to the intersection of County Road 5 and S.R. 124; thence Northwest on S.R. 124 to County Rd 27 also known as North Shore Drive; thence East on County Road 27 to intersection of County Road 27 and County Road 91 also known as Beechwood Road; thence North on County Road 91 to the intersection of County Road 91 and Township Road 281-A also known as Keplinger Road; thence North on Township Road 281-A to the intersection with County Road 49 also known as Stoney Point Road; thence Northwest on County Road 49 to the intersection County Road 49 and S.R. 138; thence Southwest on S.R. 138 to the intersection of S.R. 138 and U.S. 50; thence West on U.S. 50 to the intersection of U.S. 50 and S.R. 124; thence Northwest on S.R. 124 to the place of beginning.
   (B)   The city and its officers, agents and employees shall report to the Safety and Service Director any instance of dumping, placing, or creating any liquid or solid sewage, chemicals, or other material which may be introduced into the city water supply. Any liquid or solid sewage, chemicals, or other material dumped, placed, or created upon the city water shed area shall be presumed likely to become introduced into the city water supply.
   (C)   No person, firm, corporation, or agency shall contaminate the city water supply by placing pumping, discarding, or draining any substance into the city water shed area which may be injurious to humans.
   (D)   No subdivision plat shall be approved by the city unless an environmental assessment approved by the Safety and Service Director as to the possible contamination of the city water supply shall have been done to the satisfaction of the Planning Commission for any development within the water shed area and within the territorial jurisdiction of the Commission. The Commission may exempt a subdivision applicant from compliance with this regulation subject to the approval of Council by motion.
   (E)   Whoever violates this section shall be guilty of contaminating a water shed area, a misdemeanor of the first degree.
