§ 50.005 TESTING FOR SANITARY SEWER OVERFLOWS REQUIRED.
   (A)   Any property owner in the city, and any city sewer customer, shall obtain a certificate of compliance from the city prior to closing on the sale of the property.
   (B)   In order to obtain a certificate of compliance from the city, a property owner shall complete a questionnaire at the Office of the Public Utilities, or as available on the city web page, and submit the same to the city more than ten days prior to the anticipated closing date. A fee may be established by the Safety and Service Director to cover the actual cost of this program.
   (C)   Upon receipt of the completed questionnaire, the city shall conduct such tests, inspections, or investigations as are necessary to ensure that no possible infiltration and no possible overflows are present in the sewer lateral and connections associated with the property.
   (D)   In the event a possible infiltration or a possible leak is present in the sewerage associated with the property, the city shall disclose the findings to the owner, the prospective purchaser, and any realtor involved with recommendations for corrections, and the owner shall make necessary corrections or repairs and re-apply for a certificate of compliance.
   (E)   In the event no possible infiltration and no possible overflow is present in the sewerage associated with the property either upon initial inspection or upon later re-inspection, a certificate of compliance shall issue to the owner.
