§ 154.004 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ALLEYS. Minor ways which are used primarily for vehicular service access to the back side of properties otherwise abutting on a street. An ALLEY is a public way, dedicated, platted, and recorded with the recording of the final plan of a subdivision.
   ARTERIAL STREET. See STREET, ARTERIAL.
   COLLECTOR STREET. See STREET, COLLECTOR.
   COVENANT. An agreement between buyer and seller of a piece of property specifying what may or may not be done with the subject property.
   CONVEY. To make conveyance.
   CONVEYANCE. The act of making a transfer by conveyance of right, title, interest, or ownership.
   DEAD END. A short street having one end open to traffic and being permanently terminated at the other end.
   DEVELOP. To make a development, also to do any grading or filling of land, whether undeveloped or already subdivided, so as to change the drainage or the flow of water, or to do any work on the land that is capable of future use as a subdivision or development of building sites.
   DEVELOPMENT. The subdivision of land; also any work that must be performed such as “improvements prerequisite to approval of final plat”; and construction on the land.
   DIVIDE. Make a subdivision of.
   DIVISION. Subdivision.
   EASEMENT. A grant by the property owner of the use of land by the public, a corporation, or persons for a specified purpose.
   ENGINEER. A registered engineer; a person authorized to practice civil engineering as defined by R.C. Ch. 4733.
   IMPROVEMENTS. Street grading, street pavements or surfaces, curbs, gutters, sidewalks, storm sewers, culverts, sanitary sewers, water mains, cross walkways, street trees, and other appropriate items.
   LEASE. To rent or to permit the possession or use of right of possession or use for consideration, of a lot, parcel, tract, land, or group of lots, parcels, or tracts of lands.
   LOCAL or MINOR STREET. See STREET, LOCAL.
   LOT. A portion of a subdivision or other parcel of land intended as a unit of transfer of ownership or for development. The LOT need not be a part of a recorded subdivision.
   PARCEL. An ownership, lot, plat, or part of an ownership, lot, or plat.
   PARTITION. A division, separation, or subdivision; the act of making a division, separation, or subdivision.
   PERFORMANCE BOND or SURETY BOND. A personal or corporate surety agreement between a subdivider and the surety in favor of a governmental body guaranteeing the completion of physical improvements according to plan and specifications within the time prescribed by the subdivider’s agreement.
   PERSON. Any individual, group of persons, partnership, association, firm, corporation, developer, or any proprietor of lots or grounds.
   PLAN. A plan, made and adopted under R.C. §§ 711.09 and 711.10 by an appropriate commission or legislative authority including the general locations recommended for the major streets, parks, or public space.
   PLANNING COMMISSION. The Hillsboro Planning Commission.
   PLAT. The final plat of a subdivision. An accurate drawing (to a scale indicated on the drawing) of a subdivision, showing the location and boundaries of the tract, or group of parcels of land, together with the location and description of lots, streets, alleys, easements, public grounds, grades, or contour north point and other required information, and submitted to the Commission on the completion of the acts required by this chapter.
   PROPERTY. A parcel or area of real estate with specific location, size, and shape, whether platted or described by metes and bounds or otherwise, and any interest therein whether by fee simple ownership or by any other legally recognizable claim therein.
   RESUBDIVISION. Rearrangement and subdivision of a tract comprising a group of lots, parcels, streets, alleys, or any combination of lots, parcels, streets, or alleys.
   RIGHT-OF-WAY. The width between property lines of a street, parkway, alley, crossway, or easement.
   SALE. The act of selling.
   SELL. To make conveyance for considerations or for a price; to execute a deed for sale; to execute a sales contract.
   SEPARATE. Make separation of.
   SEPARATION. The partitioning or division of a lot, parcel, tract, land, or subdivision thereof, into two or more parcels of land.
   SERVICE ROADS. Minor streets which are parallel to and adjacent to the primary streets and highways, and which provide access to abutting properties and protection from through traffic.
   SETBACK LINE, BUILDING. A line indicating the minimum distance between the street easement or right-of-way line and buildings, or any projection thereof other than steps or permanently open porches, unless otherwise specifically defined.
   STREET. A right-of-way, dedicated and accepted to public use, which provides vehicular and pedestrian access to adjacent properties other than arterial or collector and local streets.
      (1)   ARTERIAL STREET. Street used primarily for fast and heavy traffic. A street of considerable continuity which serves or is intended to serve as a major traffic way within a city, county, or both.
      (2)   COLLECTOR STREET. A street or road of considerable continuity which serves or is intended to serve as the principal traffic way between large and separated areas or districts and which is the main means of access to the primary road system. These streets carry traffic from minor streets to the major system.
      (3)   LOCAL or MINOR STREET. A street which is used primarily for access to abutting properties. It is of limited continuity and is intended to serve the local needs of a neighborhood.
   STREET WIDTH. The shortest distance between the lines which delineate the right-of-way of a street.
   SUBDIVISION. The division of any parcel of land shown as a unit or as contiguous units on the last preceding tax roll, into three or more parcels, sites, or lots, any of which is less than five acres for the purpose, whether immediate or future, of transfer of ownership, provided the sale or exchange of parcels between adjoining lot owners, where a sale or exchange does not create additional building sites, shall be exempted; or the improvement of one or more parcels of land for residential, commercial, or industrial structures or groups of structures involving the division or allocation of land for the opening, widening, or extension of any street or streets, except private streets; the division or allocation of land as open spaces for common use by owners, occupants, or lease holders or as easements for the extension and maintenance of public sewer, water, storm drainage, or other public facilities.
   SURETY BOND. See PERFORMANCE BOND.
   THOROUGHFARE PLAN. The system of arterial and collector thoroughfares and ways as adopted by the Planning Commission.
   TRACT. An ownership, lot, plot, or group of ownerships or lots.
