§ 152.003 AMENDMENTS TO PROPERTY MAINTENANCE CODE.
   The following sections of the International Property Maintenance Code, 2018 Edition are hereby revised:
   Section 101.1. Insert: CITY OF HILLSBORO
   Section 103.5. Amend: Fees. The fees for activities and services performed by the department in carrying out its responsibilities under this code shall be as indicated in the following schedule.
   Penalties. Unless otherwise provided in this Chapter, the penalties for violation of this Code shall be as follows. The application of the penalties herein described shall not prevent the abatement of prohibited conditions.
   (1)   First Offense: Any person who fails to comply with a notice of violation and correction order served in accordance with Section 107, or any person who violates any other provision of this Code, shall be deemed guilty of a minor misdemeanor, and the violation shall be deemed a strict liability offense. The penalty shall be one hundred dollars ($100.00) per violation, and each day the violation continues shall be considered a separate offense.
   (2)   Second Offense: Any person who fails to comply with a notice of violation and correction order served in accordance with Section 107, or any person who violates any other provision of this Code, upon a conviction of a second offense within a two-year time period, shall be guilty of a misdemeanor of the third degree, and the violation shall be deemed a strict liability offense. The penalty shall not more than two hundred fifty dollars ($250.00), nor less than one hundred dollars ($100.00) per violation, and no more than sixty (60) days imprisonment. Each day the violation continues shall be considered a separate offense.
   (3)   Subsequent Offenses: Any person who fails to comply with a notice of violation and correction order served in accordance with Section 107, or any person who violates any other provision of this Code, upon a conviction of a third offense or more within a two-year time period, shall be guilty of misdemeanor of the first degree, and the violation shall be deemed a strict liability offense. The penalty shall be not more than five hundred dollars ($500.00) nor less than two hundred fifty dollars ($250.00), and no more than ninety (90) days imprisonment. Each day the violation continues shall be considered a separate offense.
   An inspection fee of $30.00 shall be charged for an initial inspection if a violation is found. If a further inspection is required for non-compliance after initial notification, an additional inspection fee of $30.00 shall be charged.
   Section 102.3 Amend: Application of other codes. Repairs, additions or alterations to a structure, or changes of occupancy, shall be done in accordance with the procedures and provisions of the Ohio International Building Code, International Energy Conservation Code, Ohio International Fire Code, International Fuel Gas Code, Ohio International Mechanical Code, International Residential Code of Ohio, Ohio International Plumbing Code and NFPA 70. Nothing in this code shall be construed to cancel, modify or set aside any provision of the Hillsboro International Zoning Code.
   Section 111.1. Amend: Application for appeal. Any person directly affected by a decision of the code official or a notice or order issued under this code shall have the right to appeal to the board of Zoning appeals, provided that a written application for appeal is filed within 20 days after the day the decision, notice or order was served. An application for appeal shall be based on a claim that the true intent of this code or the rules legally adopted thereunder have been incorrectly interpreted, the provisions of this code do not fully apply, or the requirements of this code are adequately satisfied by other means.
   Section 111.2. Amend: Membership of board. The board of appeals shall consist of not less than three members who are qualified by experience and training to pass on matters pertaining to property maintenance and who are not employees of the jurisdiction. Refer to City Ordinance § 155.063 BOARD OF ZONING APPEALS. The code official shall be an ex-officio member but shall not vote on any matter before the board. The board shall be appointed by the chief appointing authority, and shall serve staggered and overlapping terms.
   Section 111.2.1-111.2.5. Delete
   Section 111.3. Amend: Notice of meeting. The board shall meet upon notice from the chairman, within 20 30 days of the filing of an appeal, or at stated periodic meetings.
   Section 111.6. Amend: Board decision. The board shall sustain, modify or reverse the decision of the code official only by a concurring vote of a majority of the total number of appointed board members.
