§ 139.06 DEPOSITING POISON.
   (A)   No person shall leave or deposit dangerous drugs, poisons, or substances containing dangerous drugs or poisons in a common, street, alley, lane, or thoroughfare, or a yard or enclosure occupied by another.
   (B)   Whoever violates this section shall be liable to the person injured for all damages sustained as a result of leaving or depositing the dangerous drugs, poisons, or other substances.

   (C)   Whoever violates this section is guilty of a misdemeanor of the fourth degree. If the offender previously has been convicted of a violation of this section or a drug abuse offense, a violation of this section is a misdemeanor of the third degree.
