§ 13-206 CUTTING CURBS; PAVEMENT.
   (a)   No person shall cut any curb, gutter, street, pavement, cement, blacktop, sidewalk or excavate any street, alley or other public grounds of the city for any purpose without first obtaining a permit authorizing the same from the City Clerk.
   (b)   All persons and/or businesses wishing to make any alterations as described above shall first obtain permission to do so from the City Council. Prior to receiving such permission, all persons/businesses shall apply for a permit to do so from the City Clerk at City Hall, 205 N. Pomeroy Avenue, Hill City, Kansas. The application to be completed for such a permit shall include, at a minimum, the persons/businesses name, address, telephone number, location of the work to be performed, complete description of the work to be performed and time period in which work will be completed, together with any additional information required by the City Clerk.
   (c)   Once the work approved by the City Council has been completed, the same shall be reviewed by the City Administrator to determine whether the same complies with the permit as issued and this code of ordinances. Upon approval of the City Administrator, the city shall then restore any pavement, blacktop, sidewalk or other surfacing at the expense of the person or business for whom the changes were made.
   (d)   In lieu of the city replacing pavement, it may elect or authorize utility companies or contractors to resurface streets or sidewalks with like materials, subject to the approval of the City Administrator.
   (e)   Any and all costs and expenses incurred by the city in providing the above services shall be paid by the person/business within 30 days of completion.
