AN ORDINANCE AMENDING THE HIGHWOOD CITY CODE TO ADD ASSISTED LIVING FACILITY LICENSES
WHEREAS, the City of Highwood (“ City ”) is a home rule municipality located in Lake County, Illinois; and,
WHEREAS, pursuant to its home rule authority, the City desires to add Title 6 Chapter 8 “Assisted Living Facilities” to establish new regulations governing the licensure of assisted living facilities within the City; and,
WHEREAS, the Corporate Authorities of the City have determined that it is in the best interest of the City and the health, safety, and welfare of its residents to amend the City Code pursuant to this ordinance; and,
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE CITY OF HIGHWOOD, LAKE COUNTY, ILLINOIS, as follows:
SECTION 1. RECITALS. The recitals listed above are incorporated into this Ordinance as if fully set forth in this Section 1.
SECTION 2.AMENDMENT TO TITLE 6. Title 6 of the Highwood City Code, entitled “Police and Public Safety,” is hereby amended to add the following new Chapter 8, which shall hereafter read as follows:
Assisted Living Facilities
6-8-1: DEFINITIONS: The term “Assisted Living Facility” as used in this Chapter, shall mean a “facility”, as that term is defined in Section 1-113 of the Illinois Nursing Home Care Act, 210 ILCS 45/1-113, as may be amended.
6-8-2: LICENSE REQUIRED: No person or entity may operate an Assisted Living Facility within the City, except upon receipt of an assisted living facility license issued by the City Manager pursuant to this Chapter. All assisted living facility licenses will be for a term of one year.
6-8-3: LICENSE ELIGIBILITY: An applicant for an assisted living facility license must submit a properly completed application to the City Clerk, on a form to be provided by the City, which application must include the payment of a non-refundable assisted living facility license registration fee, in the amount set forth in the Annual Fee Resolution.
6-8-4: RENEWALS: For all applications for the renewal of an assisted living facility license, for an Assisted Living Facility to which the City received a quantity of requests for the provision of emergency medical services greater than the number of beds in such Assisted Living Facility, the applicant must also pay an Assisted Living Facility Impact Fee of $5,000 to offset the costs incurred by the City’s emergency services infrastructure caused by the high frequency of calls for service and cause at least one employee of the Assisted Living Facility charged with the responsibility of managing and overseeing the facility’s personnel, to attend an emergency medical services training class, completed within three months of license renewal, to be conducted by representatives of the Fire Department providing service to the community.
SECTION 3. CONFLICT . All ordinances and parts of ordinances in conflict with this Ordinance are hereby repealed.
SECTION 4. SEVERABILITY . If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions hereof.
SECTION 5. EFFECTIVE DATE. This Ordinance shall be in full force and effect from and after its passage, approval, and publication in pamphlet form in the manner provided by law.
