8-8-6: INDEMNITY AND INSURANCE:
   A.   Nonliability Of City; Indemnification: No application hereunder shall be complete unless the applicant has executed therein the prescribed portion pursuant to which the applicant agrees to release, indemnify, defend, and hold the city and all its officers, employees and agents harmless against any and all claims, liabilities, suits, judgments, costs and expenses, including attorney fees, arising out of or in consequence of any acts or omissions of the applicant and, as may be the case, each of its directors, officers, employees and agents in connection with the special event. Any application that is filed with the city for a special event shall constitute such a release, hold harmless and indemnification by the applicant. Any and all permits issued hereunder shall likewise be subject to all such conditions.
   B.   Insurance Requirements:
      1.   The application shall not be complete, nor shall any permit be issued hereunder unless and until the insurance requirements of this subsection are satisfied.
      2.   The minimum amount of general public liability insurance required for a special event shall be one million dollars ($1,000,000.00) per occurrence.
      3.   The applicant shall provide the city with one or more certificates evidencing the existence of insurance policies providing the applicant, and all of its directors, officers, employees and agents, as the case may be, with coverage equal to or exceeding that required in this subsection.
      4.   All insurance certificates required hereunder shall provide that the insurance will not be canceled or amended without thirty (30) days' prior written notice to the city. The applicant shall name the city as additional insured on each such general liability policy.
      5.   The applicant shall further maintain, at all times during the special event or otherwise, all such insurance and other coverage as may be required by law, such as, but not limited to, workers' compensation and unemployment coverage. (Ord. 95-O-11, 5-2-1995)
