117.04 PURCHASES FOR EXPENDITURES UNDER $25,000.
   (a)    (1)   Except as herein otherwise provided, the Mayor is hereby authorized to make purchases for any department of the Municipality for materials, supplies, equipment, labor or related items, up to and including purchases in the amount of seven thousand five hundred dollars ($7,500) per purchase, provided that Council has appropriated sufficient sums within such departments for such expenditures. Where applicable, such purchases shall be approved by the head of the department, and the Mayor. For purchases in excess of seven thousand five hundred dollars ($7,500) but not exceed the sum of fifteen thousand dollars ($15,000) per purchase, a majority of the Finance and Legislative Committee of Council shall approve such expenditures and submit the same to the Mayor for his approval, provided that Council has appropriated sufficient sums within the department for which such purchase is made for such expenditures. Any purchase in excess of fifteen thousand dollars ($15,000) shall be approved by a majority of Council and any purchase in excess of twenty-five thousand dollars ($25,000) shall be made in accordance with the provisions of Article IX of the Charter.
      (2)   No purchase made pursuant to this section in an amount in excess of fifteen thousand dollars ($15,000) but not to exceed twenty five thousand dollars ($25,000), shall be made without first obtaining at least two written price quotations from reputable persons, firms, or corporations for such purchase; provided, however, that in the event of emergency expenditures or in the event that the purchase is available from only one source, then the requirements of at least two written price quotations shall not be necessary.

   (b)    No goods or services shall be purchased, and no payments shall be made from City funds, regardless of the amount of such purchase or payment, without prior approval of Council, acting on motion, ordinance or resolution at a regular meeting, if:
      (1)    The purchase is made from, or the payment made to any elected or appointed official of the Municipality, the spouse, lineal ancestors or lineal descendants of any such official, or any corporation, partnership, association or other business entity in which any person included in any of the foregoing categories has a direct or beneficial interest; or
      (2)    The purchase or payment involves goods delivered to any person, or entity other than the City, or services rendered to or for the benefits of any elected or appointed official of the Municipality, in any individual capacity; or
      (3)    The purchase or payment involves a bill or invoice rendered to any elected or appointed official of the Municipality, in any individual capacity.
