SECTION 4.08 VACANCIES OF COUNCIL.

   Any vacancy in the Council or any office thereof shall be filled by a majority vote of the remaining members of Council. If the vacancy is not filled within thirty (30) days after it shall have occurred, the Mayor shall fill it by appointment.

   Persons appointed to fill a vacancy in the Council shall hold office for the balance of the unexpired term to which they are appointed; except that if a regular Municipal election is to be held more than one year prior to the expiration of the unexpired term, and if the vacancy occurs more than one hundred twenty (120) days prior to such election, the vacancy shall be filled by vote of the electors at such Municipal election, in the manner provided by law, and in such event the appointee shall serve until such time as the Board of Elections certifies the election of a candidate to fill the vacancy occupied by him.

   Persons appointed to fill a vacancy in the Council may be candidates for subsequent election to fill such vacancy.
