1501.28 AUTOMATED EXTERNAL DEFIBRILLATORS REQUIRED AT PHYSICAL FITNESS FACILITIES.
   (a)   Automated External Defibrillators (AED) Required; Definitions.
      (1)   The installation of automated external defibrillators (“AED’s”) shall be required at all physical fitness facilities in the City.
      (2)   Whenever used in this section, “automated external defibrillator or “AED” means a portable electronic apparatus used to counteract atrial or ventricular fibrillation by application of a brief electric shock to the heart and which is designed to be automated such that it can be used by persons without substantial medical training who are responding to a cardiac emergency.
      (3)   Whenever used in this section, “physical fitness facilities” are defined as places of business, whether for profit or not for profit, with structured fitness activities or programming, exercise equipment or facilities for exercising and/or improving physical fitness.
   (b)   Installation and Maintenance Standards.
      (1)   AEDs required by this section shall be installed and maintained by the owners of the physical fitness facility in sufficient numbers and in locations so that an A.E.D. device shall be accessible within three (3) minutes in the event of an emergency, in accordance with American Heart Association recommendations and any guidelines and requirements established by the City’s Chief of Fire and authorized by the Director of Public Safety.
      (2)   AEDs shall be maintained in good operating condition, shall comply with the manufacturer’s recommendations and repairs shall be made whenever necessary to assure proper operation.
   (c)   Training. Periodic training on the use of the AED device(s) for the employees of the facility shall be the responsibility of the owner of the physical fitness facility. The Fire Department, with approval from the Fire Chief, may offer periodic training to facility employees.
   (d)   Inspection; Enforcement. All A.E.D. installations at physical fitness facilities shall be subject to periodic inspection by the City’s Division of Fire or its designee, who shall have the authority, at reasonable times and upon oral notice, to enter upon any physical fitness facility premises within the City, to verify the installation and proper operation of an AED. The Division of Fire shall make and enforce such rules and regulations as deemed necessary for the enforcement of the provisions hereof, and for the proper determination of any charges herein provided if warranted.
   (e)   Liability of City. The requirements of this section shall not constitute acceptance by the City of any liability to maintain any equipment or to otherwise train any employee of a physical fitness facility in connection with the implementation of an AED pursuant to any section hereof.
   (f)   Penalty. Whoever violates any provisions of this section shall be guilty of a misdemeanor of the fourth degree. (Ord. 5-2014. Passed 4-22-14.)
