337.99 PENALTY.
(EDITOR'S NOTE: See Section 303.99 for penalties applicable to any misdemeanor classification.)
(a) General Chapter Penalty. Whoever violates any provision of this chapter, for which violation no penalty is otherwise provided, is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, such person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense such person is guilty of a misdemeanor of the third degree.

(b) Child Restraint Systems.
(1) Whoever is a resident of this State and violates Section 337.26 shall be punished as follows:
A. Except as otherwise provided in subsection (b)(1)B. hereof, the offender is guilty of a minor misdemeanor.
(2) Whoever is not a resident of this State, violates Section 337.26, and fails to prove by a preponderance of the evidence that the offender’s use or nonuse of a child restraint system was in accordance with the law of the state of which the offender is a resident is guilty of a minor misdemeanor on a first offense; on a second or subsequent offense, that person is guilty of a misdemeanor of the fourth degree.
