1501.27 MINI-STORAGE FACILITIES.
   (a)   Definitions. Mini-storage facility includes all storage facilities which are the main or accessory use of the building and are available to the general public for short or long term storage of products, general merchandise or personal items and property.
   (b)   Permit Required. A permit shall be required for the storage of any quantity of the following Hazardous Materials, as defined in the Ohio Fire Code:
      (1)   Combustible liquids.
      (2)   Cryogenics.
      (3)   Explosives.
      (4)   Flammable gas.
      (5)   Flammable liquids.
      (6)   Flammable solids.
      (7)   Organic peroxide.
      (8)   Oxidizers.
      (9)   Pyrophoric materials.
      (10)   Unstable materials.
      (11)   Water reactive materials.
      (12)   Corrosives.
      (13)   Toxic materials.
      (14)   Irritants.
      (15)   Radioactive materials.
      (16)   Tire storage.
      (17)   Other health hazards, as defined in the Ohio Fire Code.
   (c)   Responsibility.
      (1)   It shall be the lessors responsibility to control the storage of any of the above materials.
      (2)   The lessor (owner) shall be responsible for any and all costs associated with fire inspections, citations and recovery of costs associated with emergency actions for each unit and the site in its entirety. The lessor will retain all rights of subrogation against the lessee.
   (d)   Inspections.
      (1)   The Fire Chief, Fire Prevention Officer, and all Firefighters as directed by the Chief, shall have access to the individual storage units for the purpose of inspection to determine compliance with the Highland Heights Fire Prevention Code.
      (2)   The lessor shall retain the right of entry and be available to open each unit for fire inspections during all reasonable business hours.
      (3)   Such inspections may be conducted two times per calendar year, not including re-inspections for violations found.
