1323.02 PERMANENT DRIVEWAYS.
   (a)   New Construction. All driveways constructed on residential lots shall be of four-inch concrete on a three-inch slag base from the garage to the right-of-way line, and six-inch concrete on a three-inch slag base within the right-of-way. A permanent driveway must be constructed within eighteen months of the obtaining of a building permit for new construction.
   (b)   Existing Residential Structures. Permanent concrete or asphalt driveways are required for all new attached, detached, and relocated detached garages. Driveway installation is required at the time of construction.
      (1)   EXCEPTION 1. Replacement, attached and detached garages when reconstruction in the same location, and where a stone driveway already exists, the stone driveway shall be permitted to remain.
      (2)   EXCEPTION 2. New attached and detached garages which are constructed at a point where they meet a preexisting stone driveway at the entrance of the new construction, then the pre-existing stone driveway shall be permitted to remain.
      (3)   EXCEPTION 3. Relocated attached garages: Driveways may be a minimum of ten (10) feet along the side of the structure.
   (c)   Should the Building Department find a new residential lot which has not constructed a permanent driveway, written notification of such findings shall be sent to the property owners within ten days of the date of inspection, by certified mail, addressed to the property owner at this tax mailing address; and each property owner shall be given a reasonable period, not to exceed sixty days, from and after the mailing of such notice, to correct whatever defects have been found by the inspection.
   (d)   Two Car Garages. All driveways leading to a two car garage shall have a minimum width of eighteen feet and a maximum width of twenty feet from the garage to the right-of-way line. The width of such driveway at the curb line shall be twenty-four feet and taper to the sidewalk to not less than eighteen feet nor more than twenty feet.
   (e)   Three Car Garages.  
      (1)   Side entrance. All driveways leading to a three car garage facing a sideyard shall have a garage threshold not wider than thirty-two feet and shall have a garage apron not less than twenty-seven feet between the garage threshold and the point closest to the sideyard line provided that it does not violate the required sideyard set back. All driveways leading to such garages shall be twenty-four feet at the curb and shall taper to the sidewalk to a width of eighteen feet and remain at such width to the garage apron.
      (2)   Rear entrance. All driveways leading to a three car garage facing a rearyard shall have a garage threshold not wider than thirty-two feet and shall have a garage apron not more than twenty-nine feet between the garage threshold and the point closest to the rearyard line provided that it does not violate the required rearyard set back. All driveways leading to such garages shall be twenty-four feet at the curb and shall taper to the sidewalk to a width of eighteen feet and remain at such width to the garage apron.
      (3)   Front entrance.  All driveways leading to a three car garage facing a front yard shall have a driveway not wider than thirty-two feet at the garage threshold and shall remain at such width until reaching a point twenty feet from the garage threshold, at which point it shall taper to a width of eighteen feet at a distance not more than forty feet from the garage threshold. All driveways leading to such garages shall be a maximum width of twenty-four feet at the curb and shall taper to the sidewalk to a width of eighteen feet.
   Exception: Driveways incorporated with circular driveways may be a minimum of 14 feet.
   (f)   No portion of any driveway or garage apron shall be closer to the side property line than three feet.
   (g)   Circular Driveways.
      (1)   Circular driveways are permitted, however, they shall not encompass more than twenty-five percent (25%) of the green space in the front yard setback.
      (2)   All forms of concrete and similar construction, including private walks, shall be included in calculation of the twenty-five percent (25%) green space limit.
      (3)   The circular extension of a new or existing driveway shall be permitted to be a minimum of ten feet.
      (4)   Lots with a minimum of 25,000 square feet shall not encompass more than 35% of green space in the front yard setback.
