921.05 POSSESSION OF ALCOHOLIC BEVERAGES PROHIBITED.

   (a)    No person shall possess intoxicating liquor or beer within the Highland Heights Community Park, Whiteford Park, and any other park within the City limits. For the purposes of this section, the entire right of way of Community Park Drive shall be considered within the Highland Heights Community Park. When intoxicating liquor or beer is stored or transported in a motor vehicle, the driver of such vehicle, all passengers therein and all persons who have been transported therein to the Highland Heights Community Park shall be presumed to be in possession of such beverages.    (b)    Whoever violates this section is guilty, for a first offense, of a misdemeanor of the fourth degree. For subsequent offenses, whoever violates this section is guilty of a misdemeanor of the first degree.
