917.14 TREE LAWN TREE REPLACEMENT PROGRAM.

   (a)   A Tree Lawn Tree Replacement Program is hereby created by the City for the benefit of the residents. The Municipality shall pay for the initial cost of the planting of the trees in an amount not to exceed ten thousand dollars ($10,000) for the entire City in any one year. The amount paid by the City each year shall not exceed ten thousand dollars ($10,000) and shall be allocated to one ward per year on a continuing alternating basis. Any unallocated funds shall be applied to other wards as determined by City Arborists. There shall be no cost to the residents.

   The City Arborist shall have final authority as to species, type, size, location and any other factor which may effect the health, safety and welfare of the residents. The City reserves the right to utilize bidding procedures for both the installation and the purchase of such trees in order to acquire quality trees at the best market price with final specifications to be approved by the City Arborist. The City's liability shall extend concurrent with the guarantee offered by the Nursery and City approved installer. After the guarantee of the Nursery and installer expires, the City holds no further obligation as to the replacement or installation of such trees.
