705.08 PROHIBITED HOURS OF OPERATION.

   (a)    No business operation within the City whose business is conducted largely out of doors with lights, bells and exposure to transient pass-through traffic suggesting police surveillance during the night season shall be operated between the hours of l 1:00 p.m. and 6:00 a.m. Any business in actual operation on the effective date of this section and conducting activity prohibited by this section may continue but not increase such activity and once such activity is discontinued it shall not be resumed.

   (b)    The Building Commissioner shall have the authority to enforce this section and any relief from enforcement of same shall be made in the same manner as a request for relief under the Planning and Zoning Code or the Building Code.

   (c)    Whoever violates any provision of this section shall be guilty of a misdemeanor of the third degree and shall be fined not more than five hundred dollars ($500.00) or sentenced to not more than sixty days imprisonment, or both.
