541.08 REMOVAL OF TOPSOIL.
   (a)    No person shall remove or scrape the topsoil from any acreage or lot for sale as a commodity, nor grade, scrape or dig the topsoil of any acreage or lot so as to reduce the absorption of surface waters and thereby cause surface waters to accumulate or run off onto adjoining public or private property or streets.
   This section shall not apply to removal, grading, scraping or digging of topsoil pursuant to construction for which a permit has been issued, provided all other ordinances and laws are complied with, or pursuant to any other activity authorized by ordinance.

   (b)    Whoever violates this section is guilty of a minor misdemeanor.
