509.11 CROWD CONTROL MEASURES FOR CERTAIN LIVE ENTERTAINMENT PERFORMANCES.
   (a)   For the purposes of this section, the definition of “live entertainment performance”, “restricted entertainment area”, or “concert”, “facility” and “person” shall be the same as set forth in Ohio R.C. 2917.40(A).
   (b)   Not later than seven days prior to any scheduled concert the owner or operator of any restricted entertainment area or other facility shall submit to the Chief of Police a plan for security during such concert. The plan submitted to the Chief of Police shall include, but not be limited to, the number of security personnel to be on the premises commencing at least ninety minutes prior to the start of the scheduled event and who are to remain on the premises until at least sixty minutes following its conclusion; whether such security personnel are police officers, private security or otherwise; the size and nature of the crowd expected to attend the concert; the length of time prior to the scheduled start of the concert the crowd is expected to congregate at the entrances and the number and location of entrances to be used as ingress and egress for the crowd before, during and after the scheduled event.
   (c)   Not later than five days prior to any scheduled concert the Chief of Police shall return to the owner or operator of any restricted entertainment area or other facility the security plans submitted pursuant to subsection (b) hereof. The Chief of Police shall either approve or disapprove such plan for security. If the Chief of Police disapproves the plan for security he shall provide, in writing, his reasons therefor and shall further provide in writing for any additional security arrangements he feels are necessary to protect the health, safety and welfare of the participants and spectators at the concert.
   (d)   The owner or operator of any restricted entertainment facility may submit to the Chief of Police not later than fourteen days prior to any scheduled concert a request for exemption from the provisions of this section. Each such request shall state the reasons therefor and may be based upon prior crowd experience with such concerts. Not later than three business days after its receipt the Chief of Police shall notify, in writing, the owner or operator of the restricted entertainment facility whether or not the requested exemption has been granted.
   (e)   Whoever violates any provision of this section is guilty of a misdemeanor of the first degree.
