509.09 MINOR’S CURFEW.
   (a)   Age and Hour Limitations.
      (1)   No child under the age of twelve years shall loiter, idle, wander, stroll, play or be present in or upon the public streets, sidewalks, highways, roads, alleys, parks, playgrounds, or other public grounds, public places and public buildings, places of amusement, recreation and entertainment, vacant lots, business establishments, whether open for business or not, or other unsupervised places, between the hours of darkness to dawn.
      (2)   No child twelve to fifteen years of age shall loiter , idle, wander, stroll, play or be present in or upon the public streets, sidewalks, highways, roads, alleys, parks, playgrounds, or other public grounds, public places and public buildings, places of amusement, recreation and entertainment, vacant lots, business establishments, whether open for business or not, or other unsupervised places, between the hours of 11:00 p.m. and 6:00 a.m.
      (3)   No child sixteen or seventeen years of age shall loiter, idle, wander, stroll, play or be present in or upon the public streets, sidewalks, highways, roads, alleys, parks, playgrounds, or other public grounds, public places and public buildings, places of amusement, recreation and entertainment, vacant lots, business establishments, whether open for business or not, or other unsupervised places, between the hours of 12:00 midnight and 6:00 a.m.
   (b)   Exceptions. The provisions of subsection (a) hereof shall not apply to a minor accompanied by a parent, guardian or some responsible person twenty-one years of age or over, or a member of his family eighteen years of age or older, or if he or she has a legitimate excuse therefor.
   (c)   Parents Responsibility. No parent or guardian of any child described in subsection (a) hereof, shall allow such child to loiter, idle, wander, stroll, play or be present in or upon the public streets, sidewalks, highways, roads, alleys, parks, playgrounds, or other public grounds, public places and public buildings, places of amusement, recreation and entertainment, vacant lots, business establishments, whether open for business or not, or other unsupervised places, between the hours so specified.
   (d)   Violations and Penalty.
      (1)   Any parent, guardian or person in loco parentis who allows any minor to violate any of the provisions of subsection (a) hereof is guilty of a minor misdemeanor, and shall be fined not more than one hundred dollars ($100.00).
      (2)   Any minor violating any of the provisions of subsection (a) hereof shall be dealt with in accordance with Juvenile Court law and procedure.
