(a) Whoever violates Section 743.02(a) shall be guilty of a misdemeanor of the fourth degree and a fine of not more than two-hundred and fifty dollars ($250.00) or imprisonment for not more than thirty days or both. Upon subsequent convictions, the penalty shall be a misdemeanor of the third degree and a fine of not more than five hundred dollars ($500.00) or imprisonment for not more than sixty days or both in addition to any other penalties as imposed by this chapter.
