(a) No person, being the owner or in charge or control of any store or other place of business located in the same building with any room or apartment occupied for dwelling purposes, or having any entrance or show window visible from and within 500 feet of any one family, two-family, multi-family or apartment district, as defined by Chapters 1117, 1121 , 1122, 1123 and/or 1125 of the Codified Ordinances of this Village, shall transact any business in such store or place of business, or cause or permit the transaction of such business therein, or cause or permit the store or place of business to be open for the transaction of business after 12:00 a.m. or before 6:00 a.m. of any day.
(b) No person being the owner or in charge or control of any store, restaurant, or other retail food and/or beverage establishment shall cause or permit such establishment to be open to the public for business between the hours of 2:30 a.m. and 5:00 a.m. on any day.
(c) For purpose of this chapter, the terms "store or other place of business" shall not be construed to include hotels, motels, hospitals and emergency medical centers, regardless of their location in relation to any residential district, and are therefore exempt from the provisions of this Business Regulation Code.
