131.01 POWERS AND DUTIES OF THE CHAIR.
   (a)   Organizational Meeting. At the Organizational Meeting of Council to be held at the first Council Meeting in January of each calendar year, the Clerk of Council (hereinafter, "Clerk"), or in his/her absence, the Mayor shall direct an election by members of Council of one person from Council who shall be elected to the position of President for the balance of the current calendar year. At this same organizational meeting, the Clerk shall direct an election by members of Council of one person from Council who shall be elected to the position of President Pro Tem for the balance of the current calendar year.
   (b)    Presiding Officer and Chair. The President of Council shall preside and chair all regular and special meetings of Council. In the event that a member of Council elected and serving as the President of Council files petitions to run for the office of Mayor for the Village of Highland Hills, then said person shall relinquish their duties as President of Council immediately upon the filing of the petitions to run for the office of Mayor. In that event, the President Pro Tem shall assume the duties of President of Council and Council shall select among the remaining three (3) members another member to serve as President Pro Tem for the remainder of the calendar year.
   (c)    Mayor's Power to Vote. The Mayor shall have no power to vote.
   (d)    Temporary Chairperson. In the case of the absence of the President of Council, the President Pro Tem shall assume the duties of the Chair and call Council to order. In the case of the absence of the President Pro Tem, the Clerk shall call Council to order. The Clerk shall call the roll, and if a quorum is found to be present, Council shall proceed to elect, by a majority vote, a temporary Chairperson of the meeting until the appearance of either the President or the President Pro Tem of Council. (Charter, Article II, Section 4).
            (e)    Call to Order. At each meeting, the President, or in his absence, the President Pro Tem or temporary Chairperson of Council, shall take the Chair at the hour appointed for Council to meet and immediately shall call Council to order. The Clerk shall call the roll and enter into the journal the names of the members of Council present.
   (f)    Appeals from Decisions of the Chair. The Chair shall preserve decorum and decide all questions of order, subject to appeal by Council. In the event any member violates any of the Rules of Council, the Chair shall, or any member may, call him or her to order and, in the latter instance, the Chair shall render a decision as to the point of order. In case of an appeal from any ruling of the Chair, the question shall be: Shall the decision of the Chair stand as the decision of Council. The Chair shall be sustained unless overruled by a majority vote of the members of Council present. The Mayor shall have the same right to appeal.
