The decision of the Chief Building Official shall be final. However, any person with standing who feels that the CBO has wrongfully refused to issue a permit or conditional permit may appeal the decision to the Board of Zoning Appeals by filing a written notice of appeal within 10 calendar days of the CBO decision with the office of the CBO and with a copy to the Clerk of Council and Law Director. In the written notice he/she shall set forth the reasons that he believes entitle him to the permit or conditional permit. The CBO shall thereupon notify the BZA and bring the appeal before the Commission for hearing not later than the next regular meeting or within 30 days whichever time period is shorter. The BZA may, by a majority vote of the members appointed thereto, take the following action:
(a) Deny the appeal; or
(b) Overrule the Chief Building Official and order the Certificate of Occupancy issued.
