1311.01 CERTIFICATE OF OCCUPANCY PERMIT REQUIRED.
   (a) Any house or other commercial or residential structure now being or hereafter constructed within the limits of the Municipality shall not be occupied or used until a Certificate of Occupancy is obtained from the Chief Building Official.
   (b) The Chief Building Official shall not issue a Certificate of Occupancy to the owner of any house, or commercial or residential structure, until the following requirements have been met:
      (1)    A continuous means of egress has been provided, paved with concrete, asphalt, gravel or other similar substance, from the house or structure to the public street or sidewalk in front of the sub-lot;
      (2)    Proper provision has been made for the drainage and disposal of sanitary and storm sewage and other liquid wastes in accordance with the regulations of the Municipality and the statutes of the State;
      (3)    All of the requirements of the Building Code and Zoning Code have been met;
      (4)    A heating unit to be used in heating the entire house and a unit for heating hot water have been installed and are in operable condition;
      (5)    If natural gas is to be used to meet any of the requirements of this section, then such gas must be available inside the structure;
      (6)    If electricity is to be used to meet any of the requirements of this section, then such electricity must be available inside the structure;
      (7)    All excess building materials, soil, or other debris must be removed from the property surrounding the structure, and all trenches or excavations filled.
   (c)    No person shall move into or commence occupation of any of the following:
      (1)   Single-family dwelling;
      (2)   Two-family dwelling;
      (3)   Duplex;
      (4)   Suite within a duplex;
      (5)    Townhouse
until an occupancy permit has been obtained from the CBO. Once an occupancy permit has been applied for and granted, no further certificate is required so long as the property has been continuously used for the same purpose as originally permitted. An additional certificate of occupancy shall not be required if a certificate has been issued within one year prior to such occupancy. (Ord. 2010-17. Passed 4-14-10.)
