115.08 CERTIFICATION AS A CONTRACT PREREQUISITE.
   (a)   All contractors and subcontractors in a contract as defined in this Code, must hold a valid tract as defined in this Code, must hold a valid certificate of employment compliance or a statement of deemed compliance, unless compliance with the provisions of this Code has been waived by the Mayor as provided for herein.
   (b)    Contractors seeking certification of MBEs or FBEs shall ensure that all forms and related materials required for certification are submitted to the Director in a timely fashion. Certificates issued by the Director pursuant to Subsection 115.09(a)(1) will be valid and acceptable for one year in bids or similar contracts. Certificates issued pursuant to Subsection 115.09(a)(2) will be valid and acceptable for one year.
   (c)   If a contractor is found not to be in compliance with the applicable provisions of this Code or is found to be in default with respect to any representation made by the contractor regarding applicable provisions of this Code and upon which a certificate was awarded, then the relevant certificate may be withdrawn prior to the expiration of one year. All certificates must be renewed on forms provided by the Office of Equal Opportunity.
