115.07 COMPLIANCE WITH EMPLOYMENT GOALS.
   (a)   A contractor shall qualify for a certificate of employment compliance where the Director, from the required submittals and other information supplied by the contractor, determines that the goals established pursuant to Section 115.06 of this Code have been met.
   (b)   A contractor that has not met the goals established pursuant to Subsections 115.06(b)(1) and (2) may be deemed by the Director to be in compliance with this Code if the required submittals and other information supplied by the contractor assure the Director that the contractor is ensuring equal employment opportunities by taking specific affirmative actions, with regard to its employees, facilities and subcontractors utilized or to be utilized in the performance of the contract. In making the determination under this Subsection, the Director may require the contractor to submit the implement a written affirmative action plan containing such terms as the Director may require. When the requirements of this Subsection have been met, the Director shall issue a written "statement of deemed compliance".
   (c)   By notice in writing to the Director and the Clerk of Council, the Mayor may waive compliance with the employment goals set forth in Section 115.06 and with respect to a specific contractor seeking the award of a specific contract when, in the Mayor's sole judgment, such action is necessary to preserve the health, welfare and public safety of the Village of Highland Hills.
